1-INTRODUCTION.

These general conditions of sale govern the methods and conditions of sale of the products marketed by Antonino De Simone Srl through the website www.antoninodesimone.it and sold directly by Antonino De Simone Srl, with operational headquarters in Via Avezzana n.24, 80059 Torre del Greco (Naples). Registered office in Italy, in Via V.Veneto 21.80059 Torre del Greco REA-Naples 566148- Business Register Naples 863083 / 96- VAT number 03210421214, e-mail: info@antoninodesimone.it ,(antoninodesimonesrl@pec.it) to which it is always possible to write for information.

Each sales contract concluded between Antonino De Simone Srl (“Seller”) and the Customer through this site is therefore governed by these general conditions, which form an integral and essential part of every proposal, order and order confirmation for the purchase of products.

2-PRICES

Unless otherwise indicated, the prices of the products published by Antonino De Simone Srl must be understood as inclusive of VAT, while they do not include shipping costs, which are indicated in the order confirmation sent by the Seller to the Customer and which are therefore charged to the Customer. The prices of the products over time may be subject to updates and in this case these cancel and replace the previous ones.

3-METHODS OF PAYMENT

The payment methods are expressly indicated in the order form and are as follows:

1. CREDIT CARD. For credit cards (Visa-Mastercard), a debit authorization is required at checkout.
2. PAYPAL: in case of purchase of products with PayPal payment method, the amount is charged directly to the credit or prepaid card assigned. Credit card details are not disclosed to the Seller. In the event of cancellation, the amount will be refunded to the Customer’s PayPal account.
3. ADVANCE BANK TRANSFER: At the time of order acceptance, the seller’s IBAN will be sent to the customer. In case of payment by bank transfer in advance, the dispatch of the order takes place only upon actual crediting to the current account indicated by the Seller. The purpose of the bank transfer must include the order ID that is issued in the order confirmation email.

4-DELIVERY TIMES AND METHODS

Antonino De Simone srl uses the best express couriers (Ups, Gls, Sda) for national and international shipments.

From the moment the order is concluded by the Customer, with the payment, the Customer will receive a confirmation email, the Seller will take up to 3/5 working days to process the order. Once the product has been entrusted to the Courier, the Courier will deliver it within 72 hours, a period that can be extended for difficult areas or for problems of the courier itself. From the moment of taking charge of the product by the Courier, the tracking code of the shipment will be provided electronically to the customer;a unique code which will be the only faithful means for tracking the delivery.

In case of delay of the shipment by the Seller, the customer will be informed immediately. The causes of the delay due to the courier are not attributable to the Seller, who remains available to the Customer for information

5-SHIPPING COSTS

Shipping costs charged to the buyer are as follows:

– Euro 10.00 (ten euros) for national destinations

– Euro 20.00 (twenty euros) for European destinations

In the event of any change, the customer will receive immediate information.

For purchases over € 200.00, shipping is free.

For shipments outside Europe, the costs will be calculated and communicated to the customer by email.

6-LEGAL NOTICE OF SHIPPING AND ORDER ACCEPTANCE

The shipment of the goods takes place only after the acceptance of the order and accreditation  on the seller’s current account.

In the event of cancellation of the order by the Customer or non-acceptance by the Seller, the amount paid for the purchase will be refunded.

The cancellation of the order must take place, under penalty of forfeiture of the right to return the amount paid to the customer, before sending the purchased goods.

For each order placed, the seller issues a sales document for the material shipped.

7-SHIPPING RESPONSIBILITY

No responsibility can be attributed to the seller in case of delay in the order or delivery of the order.

At the time of delivery, the customer is required to check:

– that the packaging is intact, neither damaged, nor wet, or otherwise altered;

– that the number of packages corresponds to what is indicated in the transport document.

Upon delivery, any damage to the product or packaging must be immediately reported to the courier in writing.

The notofication must be sent to the seller, as well,  within 24/48 hours with photos demonstrating the status of the delivery, by e-mail to the address: comunicazioni@antoninodesimone.it .

 

The customer will receive a confirmation email with instructions to proceed with the return.

In the event of an item damaged upon delivery, the customer can choose one of the following options:

– direct reimbursement with the original payment method and return costs charged to the Seller.

– the replacement or repair of the damage, with return costs charged to the Seller.

 

– replacement with another product of the same quality and price……..

– a voucher for a future purchase

Refunds or replacements are made only when the damaged product is returned to the warehouse and only if the above terms and conditions are respected, otherwise it will be deemed that the item has been damaged by the customer and therefore he will not be entitled to refund or other.

In case of non-collection within 5 working days of the material present in storage at the courier’s warehouses due to repeated impossibility of delivery to the address indicated by the customer at the time of the order, the goods will return to the company and the return costs will be borne by the customer. The customer will not have the right to request a refund.

8-INFORMATION, GUARANTEE AND SUSTAINABILITY

All items are accompanied by a guarantee certificate that certifies their authenticity.

Antonino De Simone works exclusively 5 species of precious corals that are not at risk of extinction: the red coral of the Mediterranean sea, Corallium rubrum, and the Japonicum, Elatius, Secundum, Konjoi corals of the Pacific Ocean.

These species are of depth and are totally different from the madrepores of tropical reefs, or coral reefs,which are surface ones , are friable, not workable, and whose marketing is prohibited.

Ultimately, all the corals used in the artisanal and non-polluting processing are deep-sea corals, are collected selectively, are not at risk of extinction and should not be confused with shallow water coral reefs.

The final stage of coral processing is polishing with natural beeswax, if the jewel often comes into contact with sea water or even drinking water it could lose its shine while not losing its beauty.

In this case we will polish the jewel for free. However, the shipping costs remain the responsibility of the customer.

9- PRODUCT   DETAILS

Antonino De Simone srl guarantees the authenticity of all products, the quality of the materials used in the manufacture, the use of natural coral not treated with chemical materials, the authenticity of the color and the truthfulness of the declared quality.

It is necessary to remember that Asian coral is not, by nature, perfectly uniform, as it has a homogeneous side and a less homogeneous side for the presence of spots due, not to production defects, but to the characteristics of the species.

Consequently, for the reasons just described and, remembering that it is handmade, the items may differ in some aesthetic parts from what is photographed and described in the product sheet of the seller’s website.

All items are accompanied by a guarantee certificate that certifies their authenticity.

10- INFORMATION ON RIGHT OF WITHDRAWAL

In relation to the right of withdrawal in accordance with art. 52 and following (Consumer Code) of Legislative Decree no. 206/2005, the Customer has the right to withdraw from the contract, without indicating the reasons, within 14 days from when the same or a third party (i) received the product or (ii) in the case of the purchase of several products delivered separately with a single order, received the latest product.

In case of withdrawal, it is specified that the costs of returning the sold product are charged to the customer.

The right of withdrawal is exercised correctly if the following conditions are fully met:

1. the right of withdrawal must be duly exercised within fourteen 14 days starting from the date of receipt of the products .
2. the product must not have been used, worn or washed.
3. the identification tag / guarantee must be intact and still attached to the product.
4. the product must be returned in the original packaging.
5. the product must not have been damaged by the customer. See paragraph 7.

To exercise the right of withdrawal, the customer must contact the Seller by registered letter by post to the Seller’s address or by email to comunication@antoninodesimone.it or by certified email to antoninodesimonesrl@pec.it.

The Return Form in the Customer Service area must be completed in full. The Seller will send confirmation of receipt of the declaration of withdrawal.

The Seller, having ascertained that all the conditions required to exercise the right of withdrawal have been met by the customer, in accordance with art. 56 (Consumer Code) will fully reimburse the price of the products purchased, the customer being solely responsible for the costs of returning the return. Otherwise, the Customer will be contacted if the return cannot be accepted because it does not comply with the above conditions and the Seller reserves the right to keep the products and the corresponding amount for the purchase.

In the event of withdrawal in accordance with art. 57 (Consumer Code), once the withdrawal from the contract has been exercised, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which the customer communicated the withdrawal to the Seller.

11-EXCLUSION OF THE RIGHT OF WITHDRAWAL

In accordance with art. 59 of the Consumer Code, the right of withdrawal is excluded in the case of:

– Custom-made jewels.

12-RETURN FOR DEFECT OR NON-CONFORMITY.

Being natural and handmade products, the articles may differ in some parts from what is photographed. For further details, see paragraph 9.

For Antonino De Simone, the non-conformity of the product must therefore be understood as a shipping error by the company of a jewel with a code different from that ordered.

In the event of withdrawal due to non-compliance or a defect of the product (not attributable to the nature of the raw material) (and therefore error of the Seller), it is specified that the costs of returning the sold product are charged to the Seller.

13-RIGHT OF WITHDRAWAL IN THE CONTEXT OF CONTRACTS OF A SMALL ENTITY

The national rules on the right of withdrawal DO NOT apply to small-scale contracts concluded outside the trader’s business premises (off-premises contracts); (Article 47, paragraph 2, of the Consumer Code).

For the purposes of qualifying a “small-scale contract”, the limit set by national legislation is equal to 50 euros, in accordance with the provisions of EU legislation.

14- REFUND TIMES AND METHODS

In the event of a notice of withdrawal within the due time, the seller is required to reimburse the sale price within 14 days of receiving the notice of withdrawal. The refund will be made only and exclusively after the return of the returned product to the warehouse (Article 56, paragraph 3, Consumer Code)

After the Seller has received the return and checked that all the requirements have been met, the Customer will receive an e-mail confirming acceptance of the return and the Seller will activate the refund.

The actual time for crediting or returning the sums paid for the purchase of the products depends on the payment methods used.

⁃ purchase by credit / debit card: the repayment time depends on the credit / debit card management company, but usually takes place within two account statements. We remind you that the re-credit value date is the same as the debit, so no loss will be incurred in terms of bank interest;

⁃ purchase via PayPal (if available): the refund will be made to the Customer’s PayPal account and will be immediately visible. The actual refund on the credit card from the PayPal account depends on the card company involved.

⁃ in the case of a gift, the reimbursement of the sums will be made to the person who made the payment.

15-CONSUMER CODE

These Conditions for exercising the right of withdrawal, which are an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code.

16-APPLICABLE LAW

This  sales contract between the customer and the seller is concluded in Italy and governed by Italian law. Unless otherwise stated, the Italian relevant law applies.

To resolve civil and criminal disputes arising from the conclusion of this distance sales contract, the jurisdiction is that of the Seller’s Court.
